These Terms of Service (“Terms”) govern your use of the FUND ONE LLC website and services. By accessing our website or submitting an application, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. About FUND ONE
FUND ONE LLC is a commercial financing company that connects businesses with funding solutions including merchant cash advances, business term loans, lines of credit, and revenue-based financing. FUND ONE is not a bank and does not offer traditional bank loans. All financing products are subject to underwriting approval and applicable laws.
2. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Be an authorized representative of a U.S.-based business
- Have the legal authority to enter into financing agreements on behalf of your business
- Provide accurate and truthful information in all applications and communications
3. Not an Offer to Lend
Nothing on this website constitutes an offer to lend or a commitment to provide financing. All financing is subject to underwriting review, approval, and execution of a formal financing agreement. Rates, terms, and amounts are subject to change and will be disclosed in full prior to any funding.
4. Accuracy of Information
You agree to provide accurate, current, and complete information in all applications and communications with FUND ONE. Providing false, misleading, or fraudulent information may result in immediate denial of your application, termination of any existing agreement, and potential legal action. FUND ONE may verify any information you provide through third-party sources.
6. Credit Inquiries
By submitting a financing application, you authorize FUND ONE and its funding partners to obtain consumer and/or business credit reports from one or more credit reporting agencies. Initial inquiries may be soft pulls that do not affect your credit score. Hard inquiries, which may affect your credit score, will only be conducted with your explicit consent prior to funding.
7. Fees and Costs
FUND ONE does not charge application fees. However, funded products may include origination fees, factor rates, interest charges, or other costs that will be fully disclosed in your financing agreement before signing. You are under no obligation to accept any financing offer.
8. Licensing and Compliance
FUND ONE operates in compliance with applicable federal and state laws governing commercial lending and business financing. Licensing requirements vary by state. Merchant cash advances are not loans and are not regulated as loans under most state lending laws. Business loans and lines of credit may be subject to state-specific licensing requirements. FUND ONE reserves the right to decline applications from residents of states where it is not licensed or authorized to operate.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
